Agreement - 1725 (Transcribed from Old Times in Old Monmouth)Articles of agreement had, made, consented unto, and fullyagreed upon, this eighteenth day of October, in the twelfth yearof his majesties Reigne, Geogre over Great Britain & c., King,Anno dom, one thousand seven hundred and twenty-five, betweenAlice Van Kirk, of Freehold, in the Co. of Monmouth and EasternDivision of the Province of NJ the widow, and one of thelegatees of John Van Kirk, of the same place, (late deceased,)of the one part, and John Van Kirk, the son of the said John andAlice Van Kirk, of the other part, whereas the said deceasedJohn Van Kirk, in and by his last will and testament, amongseveral other gifts and bequests therein mentioned, did giveunto the said Alice Van Kirk, his loving wife, the sole use ofall his lands during her natural life. Now, these articleswittnesses, that the said Alice Van Kirk designing a marriage,which is intended to be had and solemnized between her andThomas Hankinson, of Freehold aforesaid, before the consummatingthereof, assigns over her interest in the real estate of herdeceased husband, John Van Kirk, to the above mentioned John VanKirk, her son, on the conditions and with the provisoeshereinafter mentioned, viz.: to have and to hold all her right,tytle, interest and claim in and to the said lands, (that werethe deceased John Van Kirk) to him the said son, John Van Kirkand his heirs, for and during the term of twelve years, tocommence from the date hereof, on condition that the said JohnVan Kirk shall and doe well and truly pay, and satisfye anddischarge all such debts, that are now due from or by the saidestate to be paid, either that were due by the testator at hisdecease, or since by the said Alice Van Kirk, contracted andunpaid; and after the expiration of the twelve years, for andduring the term of his natural life, on condition that the saidJohn Van Kirk shall pay and allow to his brothers and sisters,the rent that shall be reasonably adjudged by indifferent men,to be the value, that the said lands may yearly re rented att.Provided always, and it is the true intent and meaning of bothpartys in these presents, that if the said Alice Van Kirk, afterthe marriage, as above mentioned shall be consummated, shallhappen to be a widow, that then immediately, the said John VanKirk shall and will deliver to her, all the first and formerestate in the land, that was the deceased, John Van Kirk's. Inas full and ample manner as though this writing had never beenmade, and this writing is to be utterly void and of none effect,touching any thing or matter by either party after such re entryto be performed.
