Tharps by: John Tharp Post Reply | Mark Unread | Report Abuse Print Message John-- Wesley had one brother named John , they were the sons of Tom Hen Tharp (Thomas Henry} They lived at the junction of Trace Creek and anotheer small stream just over the line from Wayne County. Tom Hen was a notorious person in Wayne, Lewis and Perry Co.Tn. They are buried in the Beatty Cemetery near Hohenwald , Tn. Manuel became a minister of the Gospel and served in Kentucky for manny years. He was wounded badly in the baattle of St. Lo during WWII, where he vowed to do the Lords work if he survived , and he did. I am searching for info on Tharps in Middle Tennessee, Wayne,Lewis,Perry counties. My grandfather William Whitted/Whitehead, married Martha Pairlee Tharp in 1894, we don't believe that this was her maiden name. Her father is listed as Andy Tharp but info shows that her maiden name was Casinger. We think that she may have been "adopted" by Andy Tharp. Also looking for info on a peg legged man known as "Hen" Tharp who killed Daniel Whitehead in the early 1900's. Sounds like a good movie script but its the truth!! THE LEWIS COUNTY HERALD, April 1, 1920 Tharps Denied Bail Judge J. C. Hobbs denied Tom Tharpe halieus corpus proceeding held last Saturday without the taking of any evidence in the case. The defendants are now confined in the Maury County jail, the inditement charging murder in the first degree of Acre Hinson and the wounding of Loyd Hinson, in a difficulty last January near Hohenwald. It is started with a fist fight between Loyd Hinson and the older Tharpe near a still???. The Tharps were arrested a few days after the difficulty occurred, and after prelimiinary trial, were carried on to Columbia by the sherif of Lewis County. Tom Hen Tharpe was convicted of the murder of a man named Whitehead in Perry County in 1918 and given a sentence of twenty years. The case was appealed to the Supreme Court, where it is now pending. (The print is very hard to read) April 8, 1920 THARPS GRANTED BAIL Tom Hen and Jno. Tharp, who have been confined in the Columbia jail were released on bond Monday. It is reported that they are at home. The Lewis County Herald, May 6, 1920 THARPS JURY NOT YET COMPLETED Circuit Court reconvened Monday at 9 A.M. and a motion for a change of Venue in the case of Tom Hen, and John Tharp, for the murder of Acre Hinson was entered by Lawers for the defendants. A number of witnesses were summoned, including the Grand Jury for the present term. Quite a lengthy affidavit was presented by the defendants, setting out their reasons for asking a change of venue. The Grand Jury was called and examined under the rule and not one testified that he thought it necessary to leave Lewis County to get a fair trial. Judge Hoabbs overruled the motion, and the trial was begun Tuesday morning. 150 men having been summoned to select a Jury from. The first two men called qualified and were accepted on the Jury, and 7 were taken of the first 13 called, 38 of the next 41 disqualified the 3 being challenged by the state, 44 more names were placed in the hat and of that number 2 were accepted, 1 challenged by the defense and 41 disqualified. 50 new names were drawn and summoned to be in court Wednesday morning, 1 qualified and was challenged by the defense, 50 more were drawn and summoned to be in court Thursday morning at 9 A.M. Jurors accepted in the Tharp case are: Loyd Johnson6th district Monroe Davidson7th A. L. Baker6th Jeff Garner6th A. D. Grimes6th J. T. Baker5th D. J. Lewis 4th Jap Lucket5th Willis Sharp5th Allen Yorkx Joe A. Clayton5th The Lewis County Herald, May 20, 1920 THARPS BEING TRIED THIS WEEK JIM HARDEN TWELVTH JUROR The Jury was completed Tuesday and W. B. Hinson father of Acre and Loyd Hinson prosecutor in the case was the first witness to take the stand, he said that the boys left home at 8 A.M. on the morning of the tragedy, to see John Tharp in regard to some money that John owed them and then meant to come to Hohenwald to pay some debts they owed also some $200 he owed parties at Shubert, did not know how much John owed them but under stood it was enough to pay the debts. He learned of the killing at 3 A. M. next morning. Drs. Dabbs and Springer were the next to take the stand and both and both testified that Acre Hinsons neck was broken, which was the immediate cause of his death and not the shot. Harve Turnbow, eyewitness testified that he and John Tharp went squirrel hunting and reached the still about 2 P.M. that the trouble started about 3 P.M. Melvin James, John Tharp, and Acre Hinson were engaged in a game of Crapps, and Loyd Hinson was firing the still, the trouble started between Loyd Hinson, and Tom Hen Tharp, which was stopped by acre Hinson and John Tharp, shortly the dificulty was resumed and and John Tharp and Acre Hinson became involved, Acre he said proposed to John to stop, make friends and part the other two, they got up and Acre went and pulled Loyd off of Tom Hen, John Tharp he said walked way about 30 feet, pulled his pistol and told the Hinson boys to "walk up" Before the Hinson boys reached John Tharp he fired and Loyd fell. The next the witness noticed was Acre Hinson on the ground on his hads and knees apparently getting up. He said John Tharp shot him in the back in that position. Other witnesses have been examined but we have not been able to get their statements, the courtroom has been crowded to overflowing it having been necessary to close the door to hold the crowd back. The State completed iits evidence today. Defendants evidence now being presented. May 27, 1920 THARPS CONVICTED OF MAN-SLAUGHTER Motion For New Trial To Be Argued In July Tom Hen and John Tharp endited for the murder of Acre Hinson, Were found guilty of voluntary man slaughter and sentenced to the State Penitentiary from two to ten years in the Circuit Court here last week. The trial lasted two weeks, the first week being consumed in securing a jury. There was very little contradictory evidence, the statements of the defendants practically cooperating that of Harve Turnbow. Melvin James , and Loyd Hinson, so far as the fight preceeding the shooting was concerned, the proof went to show that Tom Tharp and Loyd Hinson first became envolved and were separated by Acre Hinson and John Tharp, and soon after, they reneewed the fight, this time John and Acre also became envolved in the fight and Acre was getting the better of the difficulty whereupon Harve Turnbow and Melvin James separatedthem and that Acre said he would quit if John would be friends and help separate the other two. Acre Hinson went and pulled Loyd off of Tom Hen and the trouble was seemingly at an end but John Tharp walked off some ten step, pulled his gun and said to the boys, "Walk up" the boys started toward him. John fired, Loyd fell, Acre in the same way fell on hands and knees and John fired a bullet into his back whilde he was in that position. During this time Melvin and Harve made swift departures Melvin not seeing the shooting, Harve however saw the boys shot and fearing that he might be next beat a hasty retreat. Loyd Hinson stated that although paralized he was concious and heard Tom Tharp tell Acre to quit groaning and atake something and hit him several times and he heard him groan no more, a lick on his own hear and he knew nothing until in the night some time, this statement was the only state evidence that was not either cooberated by the defendants or other state witnesses. The fact that Acre's neck was broken and several bruised places on his neck, which were not accounted for in the fight, and a bad bruised place on Loyd's head were strong arguments that some one had brutally beat on them after they were shot. Attorneys for the defendants entered a motion for a new trial which will be argued before Judge Hobbs here in July. The Jury first sttod nine for murder in first degree, one for murder in second degree, and two for aquital, and for sometime it looked like a mistrial, but after being sent back several times by Judge Hobbs the nine and one compromised with (??) "TWO" on voluntary manslaughter. June 3, 1920 TOM HEN THARP GOES TO PENN The Supreme Court Saturday confirmed the dicision of the Circuit Coourt of Perry County, which convicted Tom Hen Tharp for the murder of Dan Whitehead in 1918 and gave him a sentence of from 10 to 20 years in the State prison, this is the second time Tom has worn the stripes having served a sentence for Highway Robery in Hickman County several years ago, he has also served a sentence in the Federal prison at Atlanta for Counterfitting, besides jail sentences in all County jails in reach of his places of business.
