North Carolina Archives, Rec 22, page 283 poor quality copy In the name of God Amen I Susannah Nutt of the County of Wake and State of North Carolina being far advanced in age and knowing the uncertainty of Life and _______certainty of death but in my perfect mind and Senses do make publish and proclaim this my Last Will and Testament in manner and form as follows (touit) Item 1st My Soul I commend to God who gave it my body to be buried in a Christian like manner under the direction of my Executor--I give and bequeath unto my Son John Nutt one red Beadstead & bed & furniture to him and his heirs forever----I give to my Son Robert Nutt one blue bedstead bed and furniture and _____ bay Mare to him and his heirs forever. I give to my Grandson John A. Nutt (Son of John) one bedstead bed & furniture to him & his heirs forever. I give to my Grandson Henry Nutt (Son of John) one cow & calf Such a one as he may chose-out of Stock. I give to my Grand Daughter Penny Nutt (Daughter of John) my Side Sadle to her and her heirs forever. I give the balance of my Household & kitchen furniture not already disposed ______ the balance of my Stock of my Knits that I may have _____ cown fadden cotton and any other article of property not heretofore mentioned and disposed of to be equally divided between my Two sons John Nutt & Robert Nutt. I constitute and appoint my Son John Nutt as Executor to this my Last will & Testament and in witness whereof I have herewith Set my hand & Seal this 22 December 1831 In The Presence of her Wm R. King Clk WAKE COUNTY, NC - MARRIAGES - John Nutt to Susannah Tinney, 5 July 1777 Marriage Bond of John Nutt to Susannah Tinney July 5, 1777 State of North Carolina Wake County........ Know all men by these Presents that we John Nutt and John Rice both of the State and County afored. are held and firmly bound unto his Excellency Richard Caswell Esquire Governor in the sum of fifty pounds current money Or his successors in Office, to which payment well and truly to be made we bind ourselves and Each other our gearth of our heirs Exorrs y Administrator Jointly y severally firmly by these Presents Sealed with our Seals and dated this fifth Day of July AD 1777. The Condition of the above Obligations is such that whereas the above Bounden John Nutt hath this day applyed for and Obtained a Lisence to be Joined with Sussannah Tinney in the Holy Estate of Matrimony; Now if therefore there be no lawful cause to obstruct the Marriage for which the said Lisence was Obtained then the above Obligation to be Void and no Effect, _____ remain in full force and Virtue. North Carolina Archives, Rec 15, pages 161-164 In the name of God Amen I John Nutt of the County of Wake and State of North Carolina being in a low state of health and weak in body but of perfect mind and memory thanks be given unto God Calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, I do hereby make and Ordain this my last will and Testament in Manner and form as followeth to left; first of All I wish all my Just debts and all my funeral Expenses to be paid out of my Personal Estate out of such perishable property as my Executors think can best be Spared. Secondly, I give and bequeath unto my Son John Nutt our piece of Land and bounded as follows beginning at a Sweet Gum in the long branch running west along the Old line One Hundred poles to a Corner Stake thence North to Henry Seawells line thence East along said Seawells line to the Corner Ash in said long branch and its various courses to the beginning, Supposed to be Sixty Six Acres be the same more or less within these bounds to be a right Vested in him and his heirs forever. Thirdly I lend unto my beloved wife Susanna Nutt one piece of land including all that appertances to it as Houses & Orchards beginning at a Corner Stake in or at John Nutts Jr. line or corner running west along the said Old line to Henry Seawells line thence north along said Seawells line to the Corner thence East to when Said John Nutts Corner will Join Seawells line thence along said Jno Nutts Jr line to the Beginning including all the Same bounds, Supposed to be fifty Acres to be the same more or less during her life to be disposed after her death as I Shall hereafter mention. Also Our other Tract-of land I give and bequeath unto my beloved Wife Susanna Nutt and bounded as follows beginning at the place where this long Branch empties into Crab Tree Creek running South across the said Creek to Wm Atkins line thence East along Atkins line across said Creek to John Hentons Old line to a post Oak Corner thence North along Said Hentons line to John Nutts Jr. Corner thence West with his line across the long branch until it Will run a Straight line South to the Mouth of the long Branch to the beginning including all the land within these bounds to be a right Vested in her forever to dispose of as she pleases. I also give to my Wife all my household and Kitchen furniture and all my Plantation tools of every Kind and all the meat or Bacon and All my Stock of Cattle except two work Steers, and All Stock of Hop & fowls of every kind and Our mule and Our work Horse and two negroes by name of Dick and Goliah to be a right Vested in her forever to dispose of as she pleases except such things as I Shall hereafter Will away-- Fourthly I lend unto my daughter Polly Riley after the death of my Wife Susanna Nutt the Same piece of Land I have lent unto my Wife during her life including all my Houses whereon I now live and after the decease of my daughter Polly Riley I give and bequeath unto the heirs of said Polly Rileys body the same piece of land. Land to be right Vested in them forever and the Same Negro Goliah I have lent to my Wife after her death I lend the said Negro Goliah to Polly Riley during her life and after her death I give and bequeath the slave Goliah to the heirs of Polly Rileys body to be a right Vested in them & their heirs forever also the same Work Horse after the death of my wife I lend him to Polley Rilay during her life and after her death to the Heirs of her body forever-- And after the death of my Wife Susanna Nutt the same Mule I lend to her during her life I then Give & bequeath it unto my Son John Nutt also the Negro fellow Dick after the death of my Said Wife I give and bequeath him to my Son John Nutt to be a right Vested in him and his heirs forever-- Also the bed & furniture that I now lie on I have lent to my Wife during her life and after her decease I give and bequeath unto my Grand Daughter daughter of Polly Riley by name of Isabella Riley to a right Vested in her & her heirs forever-- Also it is my desire and my will that my Wife Susanna Shall take Polly help her maintain her self & Children out of the property I have left her as long as her husband James D. Riley Shall return to her and no longer. Fifthly I give unto my Daughter Gelly the Wife of Gillis Brown & Elizabeth Ruth my Daughter the wife of James B. Ruth a certain piece of Land bounded as follows & lying both sides of Crabtree Creek beginning at the mouth of the long Branch running north to John Nutts line which runs which runs along the Old line west to Seawells line thence along said Seawells line South to Wm Atkins line thence east along said line to where the piece I gave to my wife Joins Atkins line thence north to the mouth of the long Branch to be equally divided between them to be a right Vested in them & their heirs forever except the piece that runs from the mill path round on same land to the long & John Nutts Corner this 9 day of Apl 1819. And I hereby make and ordain my Worthy friend & Son John Nutt Jr and Moses Hutchens Executors of this my last Will and testament.
