In the court records of Cleveland County, North Carolina, I have foundthe will of James Vandyke prepared on January 4, 1862. The will is asfollows: "I James Vandyke of the County of Cleveland, State of North Carolina,being of sound mind and memory but considering the uncertainty of myearthly existence do make and declare this my last will and testament inmanner and form following that is to say That my executor thereafternamed shall provide for my body a decent burial suitable to the wishes ofmy relatives and friends and pay all funeral expenses together with myjust debts whomsoever and to whoever owing out the monies that may firstcome into the hands as a part or parcel of my estate. I give and evise tomy beloved wife Dolly Vandyke all that tract of land whereon I now liveincluding my Mansion house, all out houses and other improvements to haveand to hold to her the said DollyVanDike for and during the term of hernatural life in satisfaction for and in lieu of her dowes (?) and thirdsof and in all my real estate. I give and devise to my youngest sonWilliam Robert Vandyke all this tract of land whereon I now live exceptthe life estate of my wife devised in a former item of this my will tohave and to hold to him and his heirs in fee simple forever. I give andbequeth to my said beloved wife Dolly Vandyke all my husehold and kitchenfurniture all my stock of sheep, cattle and hogs all the domestic fowlsand poultry and my grey horse and wagon and all the crops of everydescription that may be upon the plantation where I now live and all theprovisions on hand at the time of my death. I give and bequeth to myeldest son Joshua Vandyke all my blacksmith tools to have and to hold tohim and his heirs forever. I give and bequeth to my eldest daughter NancyVandyke wife of Emanuel Mauney the sum of one dollar to be paid by myexecutor within two years after my death out of my monies belonging to myestate not otherwise disposed of which sum together with the advancementshe had from me at the time of her first marriage and ? small advancementshe had from me since that time will make her a fair and equitableportion according to the value of my personal estate to be hers and ather disposal absolutly forever. I give an bequeth to my son James A.Vandyke the sum of one dollar as his right and (?)forever to be paid bymy executor in the manner as the last bequest is made under the same (?)in reference to former advancements. I give and bequeth to my daughterBarbara S. Vandyke, wife of Feridith Carpenter the sum of one dollar tobe paid by my executor in the manner the foregoing bequeths and is madeunder the same views in reference to former advancements. I give andbequeth to my son Joseph Vandyke the sum of one dollar to be paid by myexecutor in the same manner as in the above bequeths. I give and bequethto my son Lewis S. Vandyke the sum of one dollar to be paid by myexecutor in the term of two years after my death. My will and desire isthat the residue of my estate after taking out devises and bequeths abovementioned shall remain on the plantation for the sole use of my wife andyoungest son and my will is that my wife and my son William R. Vandykepay all of my just (?) and lastly do hereby constitute and affirm my sonWilliam R. Vandyke my lawful executor to all interest and purposes toexecute this my last will and testament according to the true intent andmeaning of the same and every part and clause thereof hereby revoking anddeclaring utterly void all other wills and testaments by me heretoforemade. In witness whereof I the said James Vandyke do hereunder set myhand and seal this the 4th day of January A. D. 1862."
